01Who we are

The Service is operated by:

References to “we”, “us” and “our” mean AD Driving Roads. “You” means the person using the Service. Our full legal disclosures (Impressum) and our Privacy & Cookie Policy form part of your relationship with us.

02The Service

Driving Roads is a discovery platform for driving enthusiasts. It analyses road geometry and terrain data to rate roads for their driving character — curvature, hairpins and elevation change — and surfaces them on an interactive map, expressed as a Thrill Score.

The Thrill Score is an algorithmic rating produced from geographic data. It reflects the shape and profile of a road, not its safety, legality, surface condition, current accessibility, or suitability for any particular vehicle, driver or purpose. It is intended to help you discover roads, not to plan or navigate a journey. See section 11.

We continually add roads and regions, refine our ratings, and add, change or remove features. The Service is provided for personal, non-commercial use.

03Accounts & eligibility

You can browse much of the map without an account. Some features — such as saving roads, marking roads as driven, and Pro features — require you to register.

• You must be at least 16 years old to create an account. To purchase a paid plan you must additionally have the legal capacity to enter into a binding contract (in Austria, generally 18 years, or with the consent of your legal guardian).
• You must provide accurate information and keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorised access.
• One account per person. You may sign in with email and password or via Google, where offered.

We may suspend or close an account that breaches these Terms, is used unlawfully, or poses a risk to the Service or other users.

04Plans, pricing & billing

Driving Roads offers a free plan and a paid subscription (“Pro”). The features included in each plan are described on our Plans page and may be adjusted over time.

Pricing

• Pro annual — USD 100 per year.
• Pro monthly — USD 10 per month.

Prices are shown in US dollars and include VAT where applicable. The total price and billing interval are shown to you before you confirm your purchase.

Features

We reserve the right to add, change or remove features within the Pro plan. Where a change would materially reduce the Pro plan during a term you have already paid for, we will give you advance notice and the option to cancel, with a pro-rata refund of the remaining prepaid period.

Automatic renewal

A Pro subscription renews automatically at the end of each billing period (monthly or yearly) at the then-current price for that plan, unless you cancel before the renewal date. You authorise us, through our payment provider, to charge your payment method for each renewal. We will send a receipt for each payment.

Price changes

If we change the price of a plan, we will notify you in advance by email. The new price applies from your next renewal after the notice period; if you do not accept it, you may cancel before it takes effect and your subscription will end at the close of your current period.

05Right of withdrawal (consumers)

If you are a consumer in the EU, you have a statutory right to withdraw from a distance contract (such as a Pro subscription) within 14 days without giving any reason. The period begins on the day the contract is concluded.

To exercise this right, send us a clear statement of your decision to withdraw — for example by email to team@contentgrowthlab.com, or using the model withdrawal form below. The deadline is met if you send your notice before the 14-day period expires. If you withdraw in time, we will refund all payments received for the withdrawn contract without undue delay and no later than 14 days after we are informed.

Immediate access & loss of the withdrawal right

Pro is a digital service that begins as soon as your subscription is active. If you expressly ask us to begin providing Pro during the 14-day period and acknowledge that you will lose your right of withdrawal once the service has been fully performed, the withdrawal right ends accordingly. Where you withdraw after performance has begun but before it is complete, you may owe a proportionate amount for the service already provided. We ask for this consent and acknowledgement at checkout.

06Cancellation & termination

You can cancel Pro at any time from your account settings or via the customer portal provided by our payment provider. Cancellation stops the next renewal. Your Pro access continues until the end of the period you have already paid for, after which your account reverts to the free plan.

Except where required by law (for example, under the right of withdrawal above, or your statutory warranty rights), payments already made for a current billing period are not refunded on a pro-rata basis.

You may delete your account and associated data at any time from your settings. We may retain limited information where we are legally required to do so — for example, invoicing and tax records for the statutory retention period.

07Payments

Payments are processed by our payment provider, Stripe. When you subscribe, your payment and card details are handled by Stripe under its own terms and privacy policy; we do not store your full card details on our systems.

If a payment fails or is reversed, we may retry the charge, suspend Pro access, or downgrade your account until payment succeeds.

08Acceptable use

When using the Service, you agree not to:

• scrape, harvest, bulk-download or systematically extract road data, ratings or other content, or access the Service through automated means, except as we expressly permit;
• copy, resell, redistribute or commercially exploit the Service or its content;
• reverse-engineer, decompile or attempt to derive the underlying rating methodology or source code, except to the extent this restriction is prohibited by law;
• circumvent usage limits, access controls, or the boundary between free and paid features;
• interfere with, overload or disrupt the Service or its infrastructure;
• use the Service unlawfully, or in a way that infringes the rights of others.

09Your content

Some features let you add content — for example marking roads as driven, saving roads, or adding notes, dates and ratings to your logbook. You keep ownership of what you contribute. You grant us a non-exclusive licence to store, process and display that content as necessary to operate the Service for you.

You are responsible for your content and confirm you have the right to submit it. Do not submit anything unlawful, infringing or offensive. We may remove content that breaches these Terms.

10Intellectual property & data sources

The Service — including the software, design, branding, the Driving Roads name, and our original rating methodology and Thrill Score — is owned by us or our licensors and is protected by intellectual property law. We grant you a limited, personal, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.

11Road safety & important disclaimer

You are solely responsible for how you drive. In particular:

• Always obey all applicable traffic laws, speed limits, signage and local restrictions. Never treat a rating as an invitation to drive quickly or beyond legal limits.
• Drive within your own ability and the limits of your vehicle, and adapt to weather, traffic, visibility and road surface at all times.
• Roads change. Closures, roadworks, seasonal access, tolls, one-way sections, condition and hazards may not be reflected in our data. Verify conditions before and during your drive using official and real-time sources.
• Do not interact with the Service while driving. Plan before you set off, and use a proper navigation system for turn-by-turn guidance.

Our data may be incomplete, outdated or inaccurate. To the fullest extent permitted by law, you assume the risks of driving, and we are not responsible for accidents, injuries, fines, damage or loss arising from your use of roads discovered through the Service. Nothing in this section limits liability that cannot be limited by law (see section 13).

12Availability & warranties

We work to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, error-free, or that the data and ratings are complete or correct. Maintenance, updates and factors outside our control may cause downtime.

Where you are a consumer, your mandatory statutory warranty rights under Austrian and EU law (including for digital services) remain fully unaffected by these Terms. The limitations above apply only to the extent the law permits.

13Liability

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law — including liability for intent, gross negligence, injury to life, body or health, or under the Austrian Product Liability Act. The limitations in this section apply only within those bounds.

Subject to the above, and for damage caused by slight negligence, we are liable only for the breach of an essential contractual obligation, and our liability is limited to the foreseeable damage typical for this kind of contract. Any further liability for slight negligence — including for indirect or consequential loss, lost profits, or loss of data — is excluded to the extent permitted by law.

Your driving is entirely your own responsibility. The Service is a discovery tool — not a safety, road-condition or navigation service. We are not responsible or liable for how, where or how fast you drive, for your decisions behind the wheel, or for any accident, injury, fine, vehicle damage or other loss arising from your use of roads you discover through the Service, or from your reliance on our ratings or data.

14Changes to the Service & Terms

We may modify, add or remove features, and we may update these Terms — for example to reflect new features, legal requirements, or changes to our plans. If a change is material, or affects a paid subscription, we will notify you in advance by email or in the Service.

Changes that affect your ongoing subscription take effect only from your next renewal, and you may cancel before then if you do not accept them. Your continued use of the Service after a change takes effect means you accept the updated Terms. The current version is always available on this page.

15Third-party services

The Service relies on third-party providers — including Mapbox (maps), Supabase (hosting and database), Vercel (hosting), Stripe (payments), Resend (email) and Google (sign-in and analytics). Their services are governed by their own terms. We are not responsible for third-party services, and links from the Service to external sites do not imply our endorsement.

16Data protection

We process personal data in accordance with the GDPR and Austrian data protection law. How we collect and use your data, your rights, and our cookie and analytics practices are described in our Privacy & Cookie Policy, which forms part of these Terms.

17Governing law & dispute resolution

These Terms and any dispute arising from them are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the mandatory protections of the law of your country of residence.

If you are a consumer, mandatory statutory rules determine which courts have jurisdiction; you cannot be sued outside, or deprived of, the courts of your place of residence where the law so provides. For users who are not consumers, the competent courts of Vienna, Austria have exclusive jurisdiction.

Consumer dispute resolution. We are not obliged to, and will not, participate in dispute resolution proceedings before a consumer arbitration board. Consumers in Austria may nonetheless contact the Internet Ombudsstelle (ombudsstelle.at) or the relevant consumer conciliation body.

18Final provisions

• Severability. If any provision of these Terms is or becomes invalid, the remaining provisions stay in effect.
• Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours in connection with a merger, acquisition or reorganisation, without reducing your rights.
• Entire agreement. These Terms, together with the Privacy & Cookie Policy and the plan details shown at purchase, form the entire agreement between you and us regarding the Service.
• Language. These Terms are provided in English only.
